By accessing or using the PamojaMeet platform, website, APIs, mobile applications, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," "your") and PamojaMeet ("we," "us," "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

6. Subscriptions & Payments

6.1 Free Tier

We offer a free tier with limited features and usage quotas. Free tier usage is subject to fair use limits. We reserve the right to modify or discontinue the free tier at any time.

Paid subscriptions provide access to additional features and higher usage limits. By subscribing, you agree to:

If you exceed your plan's usage limits (e.g., API minutes, recording storage), additional charges may apply at the rates specified in your plan. You will be notified when approaching your limits.

Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled. You may cancel your subscription through your account settings at least 24 hours before the renewal date.

8. User Content & Intellectual Property

8.1 Your Content

You retain all rights to your User Content. By using the Service, you grant PamojaMeet a limited, non-exclusive, worldwide license to host, store, process, and transmit your User Content solely for the purpose of providing the Service to you.

8.2 Our Intellectual Property

The Service, including its design, code, features, trademarks, and documentation, is owned by PamojaMeet and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.

8.4 Meeting Recordings

Recordings are owned by the meeting host. By participating in a recorded meeting, you consent to being recorded. The host is responsible for obtaining necessary consents from all participants before recording.

AI-generated content may contain errors. Transcripts, translations, and summaries are provided as aids and should not be relied upon as the sole record of a meeting. For legal or medical purposes, always refer to the original audio/video recording.

10. Telemedicine Services

10.1 Healthcare Provider Responsibility

If you use our telemedicine features as a healthcare provider, you represent and warrant that:

Patients must provide informed consent before participating in telemedicine sessions. Healthcare providers are responsible for obtaining and documenting this consent.

10.3 Not Emergency Services

PamojaMeet is NOT a substitute for emergency medical services. If you or someone you are treating experiences a medical emergency, call your local emergency number immediately.

10.4 Limitations

Telemedicine has inherent limitations compared to in-person care. PamojaMeet is not responsible for clinical outcomes. The healthcare provider is solely responsible for all medical decisions.

11. Privacy & Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

12. Disclaimers & Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

PamojaMeet is a technology platform and is NOT a healthcare provider. We do not provide medical advice, diagnosis, or treatment. We are not liable for any clinical decisions made by healthcare providers or outcomes of telemedicine consultations.

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, war, government actions, internet outages, or power failures.

You agree to indemnify, defend, and hold harmless PamojaMeet, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:

15.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at support@pamojameet.s.co.tz and attempt to resolve the dispute informally for at least 30 days.

15.2 Binding Arbitration

Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration administered by a mutually agreed-upon arbitration service. The arbitration shall be conducted in English, in Dar es Salaam, Tanzania, or remotely as agreed by the parties.

15.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

You may opt out of the arbitration and class action waiver provisions by sending written notice to support@pamojameet.s.co.tz within 30 days of first accepting these Terms. The notice must include your name, Account email, and a statement that you wish to opt out.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Tanzania, without regard to its conflict of law provisions. For disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts in Dar es Salaam, Tanzania.

For users in the European Union, you may also bring proceedings in the courts of your country of residence. For users in the United Kingdom, these Terms are governed by the laws of England and Wales.
